Olga Kubyk | Senior Associate

Olga Kubyk is a Senior Associate and an experienced aviation, marine and transport lawyer in Norton White’s aviation litigation and dispute resolution team.

Olga’s work encompasses matters involving commercial, consumer, regulatory, work health and safety prosecutions, coronial inquests, government procurement, insurance, employment, damage to aircraft, and passenger and cargo claims before various Australian state, territory and federal courts and tribunals and ad hoc and institutional arbitration tribunals (ACICA/ICC).

Olga’s recent litigation and dispute experience includes:

  • OH&S: Acting for a commercial helicopter operator in proceedings before the Court of Appeal of the Australian Capital Territory relating to a prosecution for alleged breaches of the Work Health and Safety Act 2011 (Cth);

  • Commercial Disputes: Acting for transportation operators in contractual disputes litigated in intermediary and superior courts of several States in Australia;

  • Consumer Disputes: Advising on consumer law issues under Schedule 2 of the Competition and Consumer Act 2010 (Cth) including misleading and deceptive conduct, misleading representations and unconscionable conduct;

  • Aviation Liability: Acting for aviation insurers and their insured airline and aviation insureds in passenger, baggage and cargo liability claims in courts and tribunals of various States;

  • Aviation Regulatory: Acting for aviation operators in the administrative review of decisions of the Civil Aviation Safety Authority and advising on requirements for obtaining and maintaining regulatory authorisations;

  • Intellectual Property: Advising on intellectual property litigation involving allegations of stealing confidential information;

  • Employment: Acting for various aviation and transport companies in unfair dismissal claims under the Fair Work Act 2009 (Cth), and the recovery of training bonds;

  • Property Disputes: Advising on leasing disputes, nuisance and damage to aircraft claims;

  • Shipping Disputes: Acting for a global container shipping company in relation to wrongful representations relied upon in issuing switch bills of lading, involving various consumer law issues. Advising insurers, cargo interests and transport operators on claims in relation to damaged cargo, lost and damaged containers, unpaid bunkers and arrested vessels including advising in ad hoc arbitration under the International Arbitration Act 1974 (Cth), and UNCITRAL and ACICA Rules.

Olga’s practice extends to advising on corporate and commercial matters including reviewing of commercial contracts, conducting due diligence and assisting with sale of property.

Olga has a keen interest in international law and conflict of laws having completed an internship with the International Chamber of Commerce Court of Arbitration and also at the Hague Conference on Private International Law when the Convention on the Recognition and Enforcement of Foreign Judgments in Civil or Commercial Matters was concluded in July 2019.

Olga is an executive member of New South Wales Chapter of the Aviation Law Association of Australia and New Zealand and a member of Maritime Law Association of Australia and New Zealand.
