Defences to claim for possession - undue influence by husband - Yerkey v Jones - Contracts Review Act 1980 - whether contract unjust - whether unconscionable conduct on the part of the Bank - partial volunteer - pure asset lending.
This case, which was decided on 6 February 2009, provides a useful example of the relief the Court can grant in circumstances where a financier lends money to a borrower without properly considering the borrower's ability to repay the loan.
