In Abrar Ahmad v Mitsui OSK Line Ltd, the Federal Court delves into what so far appears to have been uncharted territory as far as Australian law is concerned, namely the transfer of partial rights under bills of lading. In his decision, Justice Emmett may have redefined the way in which a party can be vested with the right to sue under a bill of lading or become a ‘lawful holder’ of that bill by allowing for the division and transfer of partial rights in respect of part of the goods carried under that bill of lading.
