Transfer of the Right to Sue under a Bill of Lading
Under uniform state-based Sea-Carriage Documents legislation, consignees or endorsees named in a bill of lading or to whom the property subsequently passes, have the same rights of action and are subject to the same liabilities in respect of the goods as if they were parties to the original contract with the carrier. This article compares our domestic regime with that in Singapore, using the recent decision of UCO Bank v Golden Shore Transportation (2005) by the High Court of Singapore as example.
