Career Summary
Nathan Cecil joined Norton White in July 2004, was appointed an Associate in July 2006 and a Senior Associate in July 2008. Nathan specialises in Trade & Transport Law, and in particular, Maritime Law. Nathan practices in the areas of admiralty law, commercial litigation, dispute resolution and international arbitration as well as advising in relation to complex commercial contract negotiation, ship sale and purchase and drafting standard terms and conditions and advising on incorporation of terms.
Nathan’s clients include P&I and Defence Clubs, local and foreign ship owners and charterers, local agencies of international shipping lines, large wholesale freight forwarders, commodities traders, salvage/towage operators and road transport operators.
Nathan’s recent experience includes:
- Negotiating the release from arrest of a vessel in relation to a US$18 million charterparty dispute.
- Acting for ship owners in successfully enforcing an international arbitration clause in relation to a $4 million charterparty dispute involving litigation in the Federal and High Courts of Australia, UK High Court of Justice, US Supreme Court and London arbitration and involving issues of in rem arrest and insolvency.
- Acting for ship owners in relation to the sale of a luxury yacht.
- Acting for the owners of vessels in admiralty proceedings for damage done by the discharge of oil from another vessel whilst in port.
- Acting for professional salvors in the first significant Australian common law salvage case in 20 years.
- Defending Owners and ship’s crew in criminal oil spill prosecutions.
- Providing regulatory and commercial advice to a major international investment banking group in relation to commodities trading.
- Providing regulatory advice to a significant Australian steel producer and a large bulk commodity storage company in relation to national chain of responsibility and driver fatigue management regulations.
- Advising a large wholesale freight forwarder in relation to single pricing amendments to the Trade Practices Act.
- Acting for various local agencies for overseas shipping lines in relation to cargo claims, enforcement of contractual debts and commercial contract drafting.
- Providing ongoing commercial and operations advice to ship’s agents in port.
